Death Penalty Is Dying

The death penalty is dying, but it lingers in hospice. See an excerpt from an article by "Independent":

In 2015, only 28 people were executed here, the least in a quarter century (and one of them after a 36-year wait on death row). Moreover, all but four died in just three states: Texas, Georgia and Missouri.

Of the 50 US states, 34 haven’t executed anyone over the last five years, and soon South Carolina, another historical bastion of the death penalty, will join them.

Juries too are handing down far fewer death sentences, only 49 in 2015. Texas, long America’s chief executioner, was responsible for only two of them. For the first time in decades, the death row population has dropped below 3,000 – and only a relative handful of them will actually meet their end in the execution chamber.

Bipolar Execution Victim in Texas: Adam Ward

We are discussing capital punishment at my Facebook page. I am an anti-DP advocate and believe executions must end in the USA. This is particularly true for mentally ill Americans like Adam Ward, a 33-year-old bipolar man who Texas executed on Tuesday, March 22. The Huffington Post recently ran a story entitled "Bernie Sanders Speaks Out Against The Death Penalty After Hillary Clinton Stands By It." Senator Sanders said, "I believe it is time for the United States of America to join almost every other Western, industrialized country on Earth in saying NO to the death penalty."

When people enter controversial comments on my Facebook page and stalkers prevent their names from linking in my response, I feel that my response is censored. Sometimes I then enter said responses in an article in this "Justice Gagged" blog. I learned long ago that the hackers work for executioners, racists, and Nazis. The people, organizations, and topics I was writing to or about when I was most harshly censored may be surprising, including the NAACP, the national adult vaccination plan, Christianity, and Michelle Obama. Anti-dp language is always certain to be censored, which is why I usually run a separate digital camera when dealing with that subject online. My films will be made available to purchase for a nominal fee at CreateSpace. Americans should know which subjects are considered exempt from free speech protections by elitist Nazis.

Kudos, Nebraska: No More DP

Nebraska abolitionists are to be congratulated, as are all people who place high value on humane solutions to crime and who advocate an end to America's barbarism. Nebraska became America's first conservative state to end capital punishment. We appreciate Nebraska's legislature for doing that. The Atlantic was one of many media companies that published the victory. A brief excerpt from The Atlantic is below:

Nebraska on Wednesday [May 27, 2015] became the first conservative state in more than four decades to repeal the death penalty. Its legislature, officially non-partisan but dominated by Republicans, voted by the narrowest of possible margins to override a veto by Governor Pete Ricketts, and enact a law scrapping a punishment that the state has struggled to carry out.

Most anti-dp organizations try to appeal to hardhearted people's sense of compassion. Newsflash: Elite white supremacists have no compassion; their god is money. It costs up to $90,000 more per year to warehouse each inmate on death row than to house him/her in the general prison population, according to the Death Penalty Information Center. Our Davis-MacPhail Truth Committee usually addresses the financial burden that executioners make taxpayers bear because they are money-hungry and bloodthirsty. If executioners were not so mercenary, death row inmates would be executed long before they are, 10 years to 30 years after sentencing. But prison investors keep condemned people alive on death row for decades, not out of compassion but to make more money. That is good news, because most people who were finally exonerated were imprisoned for a very long time. If condemned people were executed sooner, America would execute many more innocent people.

The Davis-MacPhail Truth Committee believes that abolitionists must make executions more expensive.  We advocate for LAWSUITS after each execution if any reason at all can be found to sue. Executions would get more media exposure by suing. Anti-DP organizations should sue after mentally ill people are executed. Sue after potentially innocent people are executed, especially if DNA tests were denied. Sue after guilty people are executed if the executions were torturous. Sue, sue, sue. Lawsuits mean significantly more to killers than candlelight vigils do. Webcasts: UN CAT Reviews USA on DP and More

The USA is one of the 156 States parties to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment and is required to undergo regular examinations of its record before the Committee of 10 independent experts. The Committee will engage in a dialogue with the US government delegation and also hear from NGOs.

ACLU vs. PA over DP Drugs


ACLU sues Pennsylvania for information about lethal injection cocktail
SEPT. 11, 2014
The Pennsylvania chapter of the ACLU, The Guardian, the Philadelphia Inquirer, the Pittsburgh Post-Gazette, and the Philadelphia City Papers are asking state courts to unseal documents that would reveal how, and from whom, the state obtained the drugs it plans to use to execute Hubert Michael, Jr. on September 22.

Hubert L. Michael Jr. pled guilty in October 1994 to kidnapping and first-degree murder for the death of 16-year-old Trista Eng. On July 12, 1993, Eng was walking along Route 15 from her home to her summer job at a restaurant in Dillsburg, York County. Michael stopped and offered the girl a ride to work, which she accepted. Michael drove to state game lands in Warrington Township, York County, where he shot Eng three times with a handgun and then hid her body in the woods.

Michael's execution will not restore Eng's life. Neither is execution necessary to save society from the murderer. Life without parole would accomplish that. Therefore, Michael's execution could only be a revenge killing. If the capital punishment is carried out, then Michael may be subjected to a lengthy, torturous execution using mystery drugs like other condemned people were this year. A state's refusal to release information about execution drugs should necessitate an automatic moratorium.

The last execution in Pennsylvania occurred in July 1999, when Philadelphia torture killer Gary Heidnik was put to death after surrendering his appeals. Executions Down, Police Violence Up


1. Anti-death penalty advocates were elated to learn that capital punishment has been eliminated or placed on hold in 36 states in the USA partly because of torturous executions in 2014 using mystery drugs. Furthermore, NPR reported on July 16, "A federal judge has ruled that California's use of the death penalty is dysfunctional and violates the constitutional prohibition against cruel and unusual punishment. U.S. District Judge Cormac Carney's ruling came in response to an appeal by Ernest Dewayne Jones, who was sentenced to death in Los Angeles in 1995 for the rape and killing of his girlfriend's mother three years earlier."

2.  While executions have decreased, police killings have increased to the point that no reduction in democide actually happened. Within one month, from mid-July until mid-August, the police body count is four killings for California and one each for Utah, Missouri, Ohio, and New York. Another beer summit might be in order to withdraw military equipment from non-military government agencies, including police departments (Ref. #1, at paragraph 10).

3.  The world is increasingly alarmed at how little freedom and justice people in America actually have. Even journalists were arrested in Ferguson, Ohio during protests over Michael Brown's shooting death by Officer Darren Wilson. Some journalists were told to turn off their cameras then attacked with rubber bullets and tear gas when they refused to comply with police orders that violated their freedom of press rights. There have been injuries among Ferguson's protesters - one that was critical - but no more deaths at the time of this writing (Ref. #2, at paragraph 10). This is #ourGaza 

4.  California police fatally shot two mentally challenged people in August, including  a 19-year-old woman in crisis and Ezell Ford, 25, an unarmed black man who witnesses say committed no crime and was completely compliant with police. California police also beat a Latino young man named Omar Abrego to death. Utah police fatally shot a 20-year-old unarmed Caucasian, Dillon Taylor. See their stories at the four(4) links below.

     iv.  THE EIGHTH UNARMED POLICE VICTIM WITHIN ONE MONTH - Salt Lake City police fatally shot Dillon Taylor, 20, on Aug. 13. The victim was unarmed when police confronted him, his brother says. Court documents show a $25,000 arrest warrant had been issued Aug. 7 for Taylor, alleging that he had violated his probation on earlier felony robbery and obstructing justice charges.

5.  *Note: The body count below does not include inmates killed behind bars. Inmates' deaths are often subject to government cover-ups, like the secret arrest and murder of mentally, physically disabled Larry Neal in Memphis Shelby County Jail in 2003, while the jail was operating under federal oversight. 6.  Many people wonder what the point of agreement was at the WH Beer Summit of 2009. The outcome did not bode well for African Americans and other minorities or disabled people of any race or age. Little information has been released at this writing about the teenager police killed in San Jose, but five of the men in the body count were unarmed blacks, one was Latino, and one was Caucasian. 7.  The USA is a member state of the United Nations and has signed certain treaties to uphold human rights within this nation. Assistance to the Incarcerated Mentally Ill (AIMI) plans to bundle 100 cases evidencing overuse of force against mentally ill people during arrests, within correctional facilities, or by hospital personnel for presentation to the World Court.  Evidence presented is expected to include long-term solitary confinement torture, brutality by law enforcement, corrections officers, other inmates or inpatients, wrongful deaths, and medical neglect. 8.  To have your case considered for inclusion in the 100 that will be presented to the U.N., please use the contact information below. AIMI plans to request restitution for victims or their successors as well as sanctions against the USA regarding its disregard for human rights of persons with mental illness. The 100 Complainants may also include victims of aggression by untreated mentally ill people or the victims' successors. 

9.  The USA's disregard for mentally ill persons is evidenced by the fact that 1.25 million mentally dysfunctional people are imprisoned (over half of the nation's inmates). They comprise over 60 percent of prisoners in long-term solitary confinement torture, some for decades. More than 50 percent of the nation's victims of police violence are mentally ill, although no exact numbers are kept (which also evidences disregard). Additionally, tens of thousands of mentally handicapped people are homeless and/or denied psychiatric treatment unless and until they prove, usually through crimes, that they are immediately dangerous to self and others. This is likely done to preserve untreated mentally challenged Americans for use as private prison commodities, including some veterans.

Thanks to justice officials, law enforcement administrators and officers who attempt to bring justice and restore peace to affected communities without further violations against citizens' constitutional and human rights.

Paul Hildwin Gets New Trial in FL

Florida Supreme Court overturned Paul Hildwin's death sentence in the 1985 Hernando murder.

Prosecutors in Paul Hildwin's original trial relied heavily on now-outdated scientific evidence that claimed to show semen and sweat found at the crime scene likely came from Hildwin, the court's ruling said. Modern DNA testing not only disproved this, but demonstrated the samples belonged to William Haverty, the boyfriend of the victim, 42-year-old Vronzettie Cox.

"We cannot turn a blind eye to the fact that a significant pillar of the State's case, as presented to the jury, has collapsed and that this same evidence actually supports the defense," the court said in a 5-2 majority ruling.

"We vacate Hildwin's conviction for first-degree murder, vacate his death sentence, and remand for a new trial."

CNN Death Row Stories Documentaries

On Sunday, March 9th, CNN will premiere its original series Death Row Stories, described by CNN as:
Death Row Stories is a series of one-hour documentaries. Each episode attempts to unravel the truth behind a different capital murder case. Executive produced by Alex Gibney and Robert Redford and narrated by Susan Sarandon, these stories call into question various beliefs surrounding America's justice system and the death penalty.
Director Alex Gibney said, “The series provides stark examples of the struggle between the powerful and the powerless.  The stakes – life or death – couldn’t be higher.”
We see this as more evidence of a change in the debate around capital punishment and a shift away from this practice. Will you help us get the word out to your networks and ask everyone you know to watch it?

Timothy Johnson: Innocent Man Released from GA Death Row After 29 Years

Timothy Johnson has been released after having spent 29 years on Georgia's death row. Death Penalty Information Center carried the following information about Johnson:

Timothy Johnson was acquitted of murder charges and released from prison in Georgia on December 5, twenty-nine years after being charged with a murder and robbery at a convenience store. Johnson had originally pled guilty to the crimes in exchange for the prosecution's agreement not to seek the death penalty. The Georgia Supreme Court overturned his conviction in 2006 because he was not properly informed of his constitutional protection against self-incrimination and his right to confront witnesses against him. The jury deliberated for only about an hour before rendering the acquittal. His family greeted him upon his release. “My heart is overwhelmed for him,” said his uncle, Willie Wilson. “I’m just elated.”

Mary Neal: If I Die Before I Awake

2.  Perhaps you believe my advocacy for justice only regards the secret arrest and murder of Larry Neal. Did you know there are 1.25 million mentally ill people imprisoned in America who should be in treatment instead? Do you realize that at least 50% of all victims of police violence are mentally ill? I use Larry's murder cover-up conspiracy as a worst-case scenario of what happens to the mentally challenged in America. All of the police officers I polled told me that they feel jails and prisons are inappropriate for acute mental patients. I think they appreciate the work I do to help decriminalize mental illness in America. After all, mental illness affects 1 in 5 people in America, meaning the police officers themselves are likely to have someone they love who struggles with mental illness, also.

3.  Mental illness is everybody's problem. We all live, shop, work, and attend school together. Community safety is enhanced when mental illness is dealt with as a health condition and not by the criminal justice system. Imprisoning people for behavior that resulted from a psychiatric crisis costs taxpayers significant amounts of money - $163,000 per year for each inmate in NY City - but it does not deliver any psychiatric benefits to jailed sick people. I believe most mental patients exit jails and prisons in worse psychiatric condition than when they entered.

4.  I am not free to simply quit my advocacy for the mentally ill, as you seem to suggest. Neither did I choose it. God chose me for this work when he allowed Memphis Shelby County Jail to secretly arrest Larry Neal (a kidnapping), keep him 18 days while denying he was incarcerated, then kill my disabled brother in 2003 by yet undisclosed means. I find it unacceptable that neither the jail nor the USDOJ that was in overview of the jail (after its lawsuit by the United States), will investigate Larry's secret murder or pay damages to his family. Instead, terrorism and censorship are applied, like the KKK in the 1940s. God said I must speak for the poor and oppressed and all who are appointed to destruction (Pv. 31:8-9). And I will continue to do that until my personal justice quest comes to a successful conclusion. If I obey God, my safety is His issue. In God I trust.

5.  Larry Neal, a heart patient, was hospitalized for over 20 years for acute mental illness, and his government covers up his murder instead of rendering justice. Larry's murder reveals that America has a system of Apartheid in its justice system that is applied to disabled people and to black citizens. We should all be glad to have that attitude revealed and demand its expulsion. 6.  Thank you for your concern and "message from Larry." My advocacy is not just for him; it is my ministry. When God is ready for me to stop, He will resolve my personal justice quest. Until then, I resolve to do His will and continue to give Assistance to the Incarcerated Mentally Ill. God's Word said, "Speak, and do not be afraid" ~Acts 18:9.

7.  I have no intention of "confronting the police," as the YouTube writer alleged. My pen is my only weapon. But if this or any government administration in Washington and officials in Georgia (the state where I live, proclaimed the nation's most corrupt), would rather see me dead than allow me to have free speech and freedom of press to advocate for mentally ill people who are imprisoned and regularly brutalized or killed by police, God may choose to martyr Mary Neal in order to accomplish His purpose. I have no doubt that such a government action would trigger the Streisand Effect

8.  My murder or harm to my family members (a continuous threat) would only promote the causes I advocate for: decriminalize mental illness, end capital punishment, eradicate racism and class prejudice from the U.S. justice system, expose The (Johnnie) Cochran Firm frauds against Africans in America, and promote peace on earth and goodwill toward men. Among my rewards would include my best sellers and award-winning films, which would be read and viewed in every library and nation in the world. Some people accomplish more in death than in life. Although "like anyone, I want to live; longevity has it's place" (MLK), I have no doubt that I would be one of those. Blessings.
